Can I opt out of the presumptive scheme once I have chosen it? What are the implications?
Yes, you can opt out. However, if you have declared income under Section 44AD for any previous year and then declare income not in accordance with the provisions of Section 44AD (i.e., you opt out) in any of the subsequent five years, you will not be eligible to opt for Section 44AD for the next five assessment years. This “five-year lock-in” rule encourages consistency. For Section 44ADA, there is no such explicit restriction mentioned in the Act, but changing schemes frequently is generally not advisable without expert guidance.
